Fundamental EU Legislation on Day-Ahead and Intraday Market

 

• Directive (EU) 2019/944 on common rules for the internal market for electricity.

• Regulation (EU) 2019/943 on the internal market for electricity.

• Regulation (EU) 2019/942 establishing a European Union Agency for the Cooperation of Energy Regulators.

• Regulation (EU) 2019/941 on risk-preparedness in the electricity sector and repealing Directive 2005/89/EC.

• Regulation (EU) 2015/1222 establishing a guideline on Capacity Allocation and Congestion Management (“CACM”) is a key piece of legislation for the single market in electricity. It sets out minimum harmonized rules for single day-ahead and intraday market coupling, including methods to calculate the capacity on cross-border lines. Importantly, CACM provides the legal basis for the designation of nominated electricity market operators (NEMOs), outlines their tasks associated with market coupling and provides a framework for their cooperation with the TSOs.

• Directive 2009/72/EC of the European Parliament and of the Council concerning common rules for the internal market in electricity and repealing Directive 2003/54/EC.

• Regulation (EU) 2011/1227 on wholesale energy market integrity and transparency (REMIT) defines a framework for identifying and penalizing insider trading and market manipulation in wholesale energy markets across Europe. Since 2015, all participants trading wholesale electricity contracts for delivery in Europe on Organized Market Places have the obligation to report information about their trading activity to ACER.

• Regulation (EU) No 2014/1348 on data reporting (EU) Regulation No 1227/2011.

• Transparency Regulation (EU) 2013/ 543 on the submission and publication of data in electricity markets.
